Early this year, Mayor Jim Kennedy appended his signature into a new law which prohibited employers, especially in private companies from investigating or inquiring about the salary histories of job applicants. Philadelphia was the first city to enact such a progressive law.
According to Karl Heideck, though this was a good piece of legislation, it came after a hard-fought battle. Before the law was enacted, the Chamber of Commerce for the Greater Philadelphia area had challenged the legality of the law noting that it was unconstitutional.
It is important to note that the law was meant to ensure that the wage gap which currently exists between women and men was reduced in the Pennsylvania. The Society for Human Resource Management noted that the law aimed at barring employers from directly inquiring from job applicant their previous salaries or independently acquiring the applicant’s salary history.
According to Karl Heideck, only employers who are based in Philadelphia City will be affected by the new law. This is despite the fact that the language of the new law seems to imply that businesses which do business with businesses based in the city. The law states that any company which does business activities through third parties may be fined $2000 if they violate the provisions of these laws.
Even though the laws have already been signed, Karl Heideck expects that there will be several legal disputes during its implementation. This is evidenced by the fact that some companies including Comcast Communications has already threatened to sue the city government. The Chamber of Commerce also filed a formal court complaint.
